1. Ownership

All content, code, design, trademarks, logos, and intellectual property displayed on the MarketPadHQ platform are the exclusive property of MarketPadHQ Corp. unless otherwise stated. Unauthorized use, reproduction, or distribution is strictly prohibited.

2. User Content

Users retain ownership of the data and content they upload to the platform. By uploading content, users grant MarketPadHQ a non-exclusive, worldwide, royalty-free license to store, process, and display that content solely for the purpose of providing the service. This license terminates upon account deletion.

3. Copyright Infringement – DMCA Compliance

MarketPadHQ Corp. complies with the Digital Millennium Copyright Act (DMCA) and responds to valid takedown notices.

If you believe your copyrighted work has been used on the MarketPadHQ platform in a way that constitutes infringement, you must submit a written notice to our designated DMCA Agent.

Your notice must include the following:

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, including information reasonably sufficient to locate the material (e.g., URL)
  • Your contact information: name, address, email address, and phone number
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

4. DMCA Safe Harbor

MarketPadHQ Corp. qualifies for DMCA safe harbor protection under 17 U.S.C. § 512. We will expeditiously remove or disable access to infringing material upon receipt of a valid takedown notice. We reserve the right to terminate accounts of users who are determined to be repeat infringers.

5. Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice with:

  • Your name, address, and email address.
  • Identification of the material removed and its location before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed in error.
  • Your consent to the jurisdiction of the Federal Court of Canada.

6. Repeat Infringers

MarketPadHQ reserves the right to terminate accounts of users who are determined to be repeat infringers. Termination is at the sole discretion of MarketPadHQ Corp.

7. Governing Law

This policy is governed by the laws of Ontario, Canada, without regard to its conflict of law provisions. Disputes arising under this policy shall be resolved in the courts of Toronto, Ontario.
